I am registered POA for my Uncle, Leslie Terry in Gloucester House Care Home and with the help of our Solicitors Hugh James I have won a legal battle for the return of all the fees I have paid on his behalf over eight years
My Uncle suffers from Alzheimer's disease and dementia, has not been out of bed for five years, he is agitated, totally confused and disorientated in time and place
Under the current Government policy, there should be a full assessment on health needs, which determines whether patients pay for their nursing care needs. I was never made aware of this possibility, but in 2008 I found out about Continuing Care and I immediately took steps. I ask my Solicitor to obtain a full assessment as I now felt it was clear that my Uncles health needs meant that he should be the responsibility of the NHS
I was amazed that despite my Uncle having annual assessments, the NHS did not perform their legal duties and inform me about the available funding, so it is very important that people who find themselves in a similar situation take legal advice
