NHS Continuing Care Empty
PostSubject: NHS Continuing Care   NHS Continuing Care Icon_minitimeMon Apr 05, 2010 11:49 am

This posting is aimed at letting people know their legal rights regarding the NHS's obligations to Continuing Care, especially people living in the UK and/or people in Bulgaria who have eldely family and relations back here

HEADLINES

£250,000 victory for war vet who sold home to pay care bill (Daily Mail)
Patient has his £250k nursing fees returned (This is Kent, Newspaper)
Family wins biggest-ever payout for nursing care (Banbury Guardian, Newspaper)
War veteran recovers 8 years of wrongly paid nursing home fees (Hugh James, Solicitors)
Live appearances on BBC south TV, BBC south east TV, BBC Radio 5 live and BBC radio Oxford

I am registered POA for my Uncle, Leslie Terry in Gloucester House Care Home and with the help of our Solicitors Hugh James I have won a legal battle for the return of all the fees I have paid on his behalf over eight years

My Uncle suffers from Alzheimer's disease and dementia, has not been out of bed for five years, he is agitated, totally confused and disorientated in time and place

Under the current Government policy, there should be a full assessment on health needs, which determines whether patients pay for their nursing care needs. I was never made aware of this possibility, but in 2008 I found out about Continuing Care and I immediately took steps. I ask my Solicitor to obtain a full assessment as I now felt it was clear that my Uncles health needs meant that he should be the responsibility of the NHS

I was amazed that despite my Uncle having annual assessments, the NHS did not perform their legal duties and inform me about the available funding, so it is very important that people who find themselves in a similar situation take legal advice

Lisa Morgan of Hugh James (nursing care) took on our case on a NO WIN, NO FEE basis

This posting is related to a personal situation but I am willing to share it with the forum, because like me, I was under the impression that I had to sell his house to fund his keep in the Care Home. THIS IS NOT TRUE
If I can be of any further or offer any advice to the forum posters, feel free to pm me
