First topic message reminder :

When we bought our house in 2007 we did not realize that BPA put our address as a shopping mall in Veliko Tornovo, We had our company moved to Shoumen in order to register our car. We have found out today that when we moved it ,it was automatically put on the company register, so we do not have to re registerd,saved us a few bob!! It might vary region to region but that is our experience in NE BG

The bill for extension of company re-registration deadline still pending

The bill for extension of company re-registration deadline is still pending. The parliament website bill section shows that the bill is still in discussion stage with the Legal commission of the Parliament. The Bill was submitted to the Parliament on 18 October 2010. Normally Bill discussions take more than 2 months, however this Bill needs to be voted as soon as possible since a lot of companies will be liquidated because they will fail to re-register. Lawyers in Bulgaria are keen this Bill to be accepted as there will be benefits for the clients. When the Bill is voted the clients won’t lose their state fees if their company applications are rejected. This was a very bad practice by the Commercial register, but was punished by several Supreme Court resolutions, defining the register’s practice as illegal.

Looking at this I think its best if everyone treats this matter as it is and not how it might be? there is very little time left now for this amendment to be passed although I believe it will be passed but it will be late which may create further problems not only for the Bulgarian parliament but also the property owner or should I say all unregistered company's. So teat the dead line as you know it to be as the only deadline Re-registering a company &

NOTE:

Failing to re-register your company

Many non-Bulgarians buy property in the country by registering a company. If this is your case and you fail to re-register your company under the new Commercial Register Act in three years term, your property may be jeopardized.

If you fail to re-register your company within the said period, the court will initiate a liquidation procedure. A shareholder will be appointed as a liquidator. If none of the shareholders could be found, the court will appoint a liquidator at its discretion.

During the liquidation the company will be assessed and all properties shall be put out to a public tender. After the tender procedure is over, the company will be closed.

To avoid the latter, don't forget to get an English speaking lawyer who will explain the whole procedure to you and will do the re-registration for you.

Bulgaria's Parliament has adopted long-anticipated changes to the Commercial Register Act extending by 6 months the legal deadline for the campaign to register anew all firms in the country.
Under the Commercial Register Act changes adopted in 2008, all active legal companies in Bulgaria are required to make new registration with the Registry Agency so that inactive and "
ghost"
firms can be eliminated from the entries.
With Friday's amendments, the deadline is extended from December 31, 2010, until June 30, 2011, based on the grounds that the initial three-year period was not sufficient to complete the registration campaign.
A little more than a month before the deadline some 300 000 firms had renewed their registration, in addition to 129 000 firms created after the changes were adopted in 2008. Almost 900 000 firms, however, have failed to do so.
The registration trends so far have largely confirmed forecasts by experts that only about one-fourth of the firms in Bulgaria are active.

Народните представители удължиха с половин година срока за преригистрацията на търговците, предвиждат промени в Закона за Търговския регистър, приети от парламента на първо четене. Измененията се предлагат заради невъзможността за пререгстрация в разумния тригодишен срок, предвиден в закона, е записал в мотивите си вносителят - Министерският съвет. Това в същото време ще мотивира, според кабинета, непререгистрираните търговци сами да поискат пререгистрация в срок. Обстоятелствата и актовете, вписвани и обявявани в Търговския регистър, се оповестяват без информация, представляваща лични данни, предвижда законопроектът. Изключение се прави за данни, за които със закон се изисква да бъдат оповестени.

От 1 януари 2011 г. да отпадне установеният държавен монопол върху резервиран сектор от универсалната пощенска услуга, предвиждат приети на първо четене от парламента промени в Закона за пощенските услуги. С измененията задължението за извършване на универсалната пощенска услуга се възлага на "
Български пощи"
ЕАД като единствен пощенски оператор, който има изградена пощенска мрежа и разполага с ресурс да осигури изпълнението на услугата на територията на цялата страна, включително в труднодостъпните райони, с определено качество и на достъпни цени. Предвиденият срок на задължението е 15 години, считано от 1 януари догодина. В законопроекта се предвижда преразглеждане на задължението за извършване на универсалната пощенска услуга на всеки 5 години с оглед неговото продължаване, промяна или отменяне. Регламентира се и механизмът за финансиране на универсалната пощенска услуга чрез компенсиране от държавния бюджет, когато задължението за извършването й води до нетни разходи и представлява несправедлива финансова тежест за пощенския оператор, на когото е възложено това задължение. Компенсацията ще се предоставя след получаване на положително решение от Европейската комисия. Измененията в Закона за пощенските услуги е изготвен в изпълнение на ангажиментите на България като пълноправен член на Европейския съюз и са в съответствие с изискванията на европейски директиви с оглед пълното изграждане на вътрешния пазар на пощенски услуги в Общността. С промените се осигурява изпълнението и се гарантира предоставянето на универсалната пощенска услуга в дългосрочен план в условията на напълно либерализиран пазар на пощенските услуги.

Отменя се разпоредбата частните съдебни изпълнители да не заплащат държавни и местни такси, когато те получават писмени справки за личните данни на длъжника. Това приеха депутатите при второто четене на промени в Закона за частните съдебни изпълнители. Според отменения вече текст, освен за извлечението от документи и лични данни, частният съдебен изпълнител не дължи заплащане на държавни и местни такси и за вписването на обезпечителни мерки.

Дейности, пораждащи минни отпадъци, не може да се осъществяват без одобрен от министъра на икономиката, енергетиката и туризма план за управление на минните отпадъци. Това приеха на второ четене депутатите, които одобриха част от промени в Закона за подземните богатства. Правителственият законопроект предвижда, Министерството на икономиката, енергетиката и туризма да е единният орган за управление на подземните богатства. С промените, операторите, които управляват минни отпадъци, вече трябва вече да представят влязло в сила решение по ОВОС. Решението на ОВОС е един от документите, които се изискват, за да потвърдят плана за управление на минните отпадъци. Разрешения за търсене и проучване и за проучване и концесии за добив се предоставят на физически и юридически лица, които са регистрирани като търговец. Те трябва да докажат необходимите управленски и финансови възможности, за да извършат дейностите, за които искат разрешение.

Not to sure about this if you look at the text from novinite it seems its all done and dusted but then looking at the Bulgarian national assembly site it only looks as though its the first reading? very confusing unless someone on here can read Bulgarian we and let us all know what it means?

These amendments are proposed because of the impossibility of registriing for the second time in three years that have been provided for by law.The Council of Ministers has noted it's reasons for this.This is at the same time motivated act, according to Cabinet non-registered traders require the re-registration period. The facts and acts recorded and advertised in the Commercial Register shall be made without the information constituting personal data, and the bill that is provided. An exception is made for data which is required by law to be disclosed.

From 1 January 2011 to eliminate the state monopoly over the reserved area of the universal postal service provide at first reading by parliament amendments to the postal service. The amendments of obligation to the universal postal service is assigned to "
Bulgarian Posts"
EAD as the only postal operator which has a postal network and because they have the resources to ensure the service throughout the country, including the difficult areas of a given place at affordable prices. The intended period of duty is 15 years from January 1 next year. The bill provides for a review of the obligation to the universal service every 5 years with a view to its continuation/modification or repeal. Regulating the mechanism of financing the universal postal service will come from compensation from the state budget when the obligation is to carry it, leads to net costs and an unfair financial burden on the postal operator, it shall be entrusted with this obligation. Compensation will be provided after receiving an approved decision by the European Commission. Changes in the Postal Services Act is provided in fulfilling the commitments of Bulgaria as a member of the European Union and also in accordance with the requirements of European directives in order to fully complete the internal market Community of postal services. The changes en-sure the implementation and provision of universal postal service in the long run in and a fully liberalized postal services.

The provision repeals private enforcement and it does not pay state and local taxes, when they receive written information about the personal data of the debtor. It took the law-makers in on the second reading of amendments by the Law on Private Enforcement. According to invalid and existing text except for the extract from the documents and personal data, private enforcement is not subject to payment of state and local taxes and the entry of injunctions.

Activities leading to mining wastes and there for can not be implemented with, without approval by the Minister of Economy and Energy management plan for mining waste. This adopted on second reading MEPs who are part of the approved amendments by the Law on Mineral Resources. The government bill for sees the Ministry of Economy and Energy as the single authority to manage groundwater resources. With this change, operators that manage mining waste, should already have submitted a final decision on EIA. The decision of the EIA is one of the documents that are required in order to confirm a plan for the management of mining waste. Permits for prospecting and exploration and mining concessions are granted to individuals and legal persons who are registered as a retailer. They must demonstrate the necessary managerial and financial capacity to carry out activities for which they need in order to apply.
