Prior to Bulgaria’s ascension into the EU a foreign national needed to form a Bulgarian company to own land. Compulsory re-registration of all Bulgarian companies was made law from January 2008 and any companies formed before that date had a legal obligation to re-register. However, there are still thousands of companies that have not re-registered.
There will still be many people who are not aware of the changes in the law regarding property ownership. Many will have been required to form companies to purchase the property but may have failed to re-register meaning technically they are no longer companies/ These companies probably have already been deregistered and must be officially closed, either voluntarily by the owners or involuntarily by the State.
It is likely that after January 2017 any companies that have not been re-registered or liquidated will be considered finally to have been struck off the Trade Register and properties potentially considered ownerless or deserted.
Anybody owning a property in Bulgaria that has not taken action should consider doing so promptly, and take professional legal advice over what can be a complex situation.
