Hi Guys

I have a question please. We are thinking of buying a car here in BG however, we are no residents. I have just been told we need to have residency to do this as we need to produce our Litchen Carte or our EU card - passport will not survice. The only way is to do this thrugh a company and of course our company is inactive and I wsh for it to remain this way, so this is not an option. We were not aware of this can anyone throw any light on it. I cannot get ot see the Norary until mid week.

How to buy or sell a used car in Bulgaria

In order for the sale of a used car between two private individuals to be considered legal, both the seller and the buyer must sign a vehicle purchase contract (Договор за покупко-продажба на МПС) in front of a Notary Public (нотариус). The contract must be signed by both parties or their legal representative(s) before it can be declared valid by the Notary. (If the car is owned by a company it is not necessary to sign at a Notary Public.) The signed contract is needed for the new owner to register the car in their name at the local Traffic Police Office.

The seller provides the following documents:

Vehicle registration document (Регистрационен талон)
The roadworthiness stamp and certificate (талон за Годишен технически преглед)
A receipt proving payment of the annual Vehicle Tax (Данък МПС) - the owner of a car receives this after paying the annual Vehicle Tax at the local Taxes and Fees Office (Местни данъци и такси)
Proof of identity
Proof of third-party insurance

The buyer will need to provide the following:

Proof of identity
Payment

Registering the Vehicle

Within 14 days the new owner must go to the local Traffic Police Office to register the vehicle. The vehicle must be registered at the Traffic Police Office in the town of the new owner's permanent address in Bulgaria.
Documents required

Local Traffic Police require the following documents for the registration:

A registration application form (provided by the local Traffic Police Office in Bulgarian)
The original vehicle purchase contract (Договор за покупко-продажба на МПС) and a copy
Proof of payment of the Vehicle Tax (Данък МПС)
A valid third-party insurance policy, compulsory for all vehicles (Гражданска отговорност)
Proof of identity
Proof of address registration obtained from the local Address Registration Office (Служба ЕСГРАОН), usually in the corresponding City Hall (Кметство).
The vehicle’s previous registration document (Регистрационен талон)

You don't need to be residents, as in "
live in BG all the time"
, just apply for a Long Term Residents card, it's fairly straight forward, ask at the local Police Station were the Immigration office is, in theory if you stay longer than 90 days in BG you should have one anyway. Many people are unaware that you have carry I.D with you at all times in BG (40 Leva on the spot fine) having this card solves the problem of carrying around their Passports and the LTR card gives you more opportunities for other things too.

My company is inactive but all cars are registered to it, saves having to reregister everytine residency expires?

Hi,
It is not a problem to buy a car with your company. It doesn't make it automatically active, however you can keep it inactive and submit nil tax returns.
Anyway, you can get residence fast and easy as a EU citizen, but the residence card you can receive will be for a period of 5 years. After that you have to register the car again to the Traffic police.
1. In order to receive a residence card you have to go to the nearest Immigration police department (in the nearest main city, where your property is located) and submit copy of your passport, proof of address (copy of your notary deed for purchasing a property). You also declare that you have health security and enough funds for living. You have to pay small fees and within few days you will have received the card. For detailed information you can ask local immigration department.

Note: Keep in mind that receiving a permanent residency means you live in BG more than 6 months in a 12 month period. As a resident of BG, aside from some cases mentioned in agreements for avoiding double taxation, you have to pay your taxes here. Also you are paying monthly health security contribution of 16.80 BGN.

2. After car purchase you have to register it to the Traffic police within 14 days. Beside other documents, you have to have third-party liability insurance, which is about 100 Euros a year, eco-taxes etc.

3. Within 2 months you have to declare the car to your municipality. You can do that by submitting a declaration, copy of the contract and/or invoice and insurance assessment \if it is bought outside BG). You have to pay one-time municipality tax of about 2% of the assessment for purchasing the car. Unlike UK in BG you are paying also annual municipality (local, community) tax on the car, which is calculated by the municipality, but it isn't so much - it depends on the car's horse power, year of manufacturing etc. Remember that you have to pay it every year just like the property tax.

4. If the car is new (up to 6 months or below 6 000 kilometers) and you buy it outside BG, but in other EU country, you have to pay VAT on the purchase. You'll pay VAT in BG. If you buy a second-hand car from an individual you won't pay VAT at all. If you buy it from a car dealer you'll pay VAT to the dealer anyway.

5. It is very important where you are going to buy the car from and what the car is. If you buy the car outside Bulgaria you should ask for a EURO 1 certificate which certifies that the car is manufactured in EU to avoid paying customs and VAT on "
import into EU"
. If the car is manufactured outside EU, but you buy it in another EU country you have to get documents proving that the cusoms and VAT are already paid. If you buy it otside EU you would have to pay VAT and customs.

Maybe I create a mess instead of helping, but that's the way it is when dealing with administration g
